Hamas sends letter to UNGA president regarding US efforts to delegitimise resistance

Chief of the Palestinian Resistance Movement Hamas sent a message to President of UN General Assembly, condemning US efforts to propose a resolution to delegitimising Palestinian resistance.

Two senior Hamas officials handed over the message to the director general of the UN office in the Gaza Strip, hoping it is delivered to the UN General Assembly President Ms Maria Fernanda Spinosa.

In addition, Hamas chief also sent a copy of the message to the member states of the UN General Assembly.

Here is the text of the message:

We in the Islamic Resistance Movement - Hamas are following up with great anger and condemnation the ongoing and miserable efforts by the United States of America, not only by adopting the Israeli narrative of the conflict, but also by providing all the necessary material and moral support for the Israeli occupation to continue its aggression against our people and deprive them of their basic rights of freedom, independence and self-determination, guaranteed by all international conventions and laws.

The last of these efforts is the attempt by the United States Ambassador to the United Nations, in the International Day of Solidarity with the Palestinian People which is held on November 29 each year, to submit a draft resolution condemning the Palestinian resistance and the right of our people to defend themselves against this racist and continuous occupation for more than seven decades. There had been not only that, but it has taken a turn when the US President Donald Trump administration sought to reduce the number of UN resolutions on the Palestinian issue claiming that "many biased resolutions against Israel are not helpful."

Ms President,

We refer the US to the support of the United Nations for the legitimacy of the resistance and national liberation movements in the world, through several important resolutions of the General Assembly between 1970 and 1985, which highlighted the international legal personality of these movements. The UN granted, for example, the Palestine Liberation Organization a permanent observer in the various organs of the United Nations, Under Resolution No. (3210) of October 14, 1974.

The rules of international humanitarian law have contributed to strengthening the legal status of the resistance and national liberation movements against the occupation, and to legitimizing their resistance activities to achieve their right to self-determination as mentioned in the First Additional Protocol to the Geneva Conventions, in particular article 1 / paragraph 4,: "The situations referred to in the preceding paragraph include armed conflicts in which peoples are fighting against colonial domination and alien occupation and against racist régimes in the exercise of their right of self-determination, as enshrined in the Charter of the United Nations.”

We greatly count on the members of the UN General Assembly and their stand by international legitimacy in support for the right of peoples to defend themselves and thwart these aggressive American endeavors.

Based on the aforementioned premises, we, the Palestinian resistance movement Hamas, emphasize on the following:

1. We stress that the Israeli occupation of our people’s lands, depriving them of their basic rights, forcible displacement and the continuation of settlement activities and siege are forms of terror. These are the main reason for the continued violence, not only in the Palestinian territories but also in the entire region, denying it of stability.

2. We condemn the continuous Israeli aggression against our people, represented by the retention of the occupation, the Judaization of the city of Jerusalem and the forcible change of the demography of the Holy City, the theft of land and the demolition of houses to build more settlements, and the tragic siege imposed on the Gaza Strip for more than 12 years.

3. We condemn the Israeli behavior of acting as an entity above the law, by rejecting dozens of international resolutions condemning the occupation, settlement and targeting civilians, and even working to abort these decisions and prevent their implementation in all ways.

4. We reiterate the right of our people to defend themselves and to resist the occupation, by all available means, including armed resistance, guaranteed by the international law. The General Assembly of the United Nations adopted dozens of resolutions that affirm the right of peoples to independence, self-determination and struggle by all available means, peaceful and non-peaceful, for that right. The UN singled out the Palestinian people for dozens of relevant resolutions, including 2621, 2649, 2787 and 3236.

5. Hamas is a Palestinian national liberation movement that seeks by all means to defend its people in order to achieve their basic rights. This comes within the context of the legitimate defense and response to the continuous aggression against the Palestinian people. This right is guaranteed by Article 51 of the Charter of the United Nations, which represents a solid basis for the legitimacy of the struggle of the Palestinian people, individually and collectively, for independence and self-determination.

6. We stress on the necessity to work hard to thwart the American efforts to condemn the resistance at the UN General Assembly.

7. The international community must act by all available and legitimate means to put an end to this abhorrent occupation and to help our people achieve their goals of freedom and independence in order to exercise their desired role in contributing positively and positively to the stability and progress of the region and the entire the world.

8. Working hard and immediately to put an end to the ongoing tragedy of our people in the Gaza Strip, which has been going on for more than 12 years, stressing that it is an illegal and inhumane Israeli siege that caused lots of troubles for two million people living in this small area.
